This midwife employed by the city of Paris injured her foot in 2021. While she was teleworking to follow training, she was ironing and the ironing board fell on her the foot. She demanded to be paid in full by the Paris town hall, believing that she had been the victim of a work accident. Justice ruled this Saturday, January 3.
The situation is quite unusual. In March 2021, a midwife employed by the city of Paris injured herself with an ironing board while she was teleworking and following training at distance. Believing that she had been the victim of a work accident, she requested from the Paris town hall to be fully paid during her stoppage, which the town hall refused, reports Actu.fr.
The reform commission had issued an "unfavorable opinion" to the request for recognition of a work accident& ;nbsp;on July 8, 2021 and the city of Paris had therefore followed this opinion by considering that "the facts declared do not relate to an act of service" ; and are even "detachable"
3 and a half years of proceedings
The midwife then took the matter to court. This followed 3 and a half years of procedures concluded this Saturday by the refusal of administrative justice to recognize a work accident.
The court in fact made the decision to dismiss the midwife based on the law of July 13, 1983: si "this accident took place during the applicant’s service, the circumstances of this accident cannot be considered as constituting the normal extension or relating to the exercise of her duties". The accident must therefore be "considered as an event detachable from the service".
