A game-changing appeal

A project to which the Departmental Commission for Commercial Development (CDAC) gave the green light on September 5, 2022, before the company Sports agathois (Sport 2000 Agde) filed an appeal a few days later, before the National Commission for Commercial Development. A request that ultimately led the CNAC to issue an unfavorable opinion on the case, after having notably highlighted "the lack of details on the brands likely to be set up", "a commercial vacancy rate of 13.12% in Agde, or 74 vacant premises", "the increase in traffic (automobile)" in the area with these new businesses, without forgetting "the 10 million euros committed to the revitalization of the city center d’Agde."

A decision contested in court

This decision by the CNAC, “we are now contesting it at the administrative level”, confirms Sébastien Prou, the boss of Hyper U. And it is precisely the administrative court of appeal of Toulouse which contacted the city of Agde so that it could give an advisory opinion on the question. Through the voice of the mayor and president of the Agglo Sébastien Frey, the municipality has also written an unfavorable opinion on this project.“I consider that the efforts made in the city center by the community to revitalize the heart of the city of Agde, with in particular the establishment of new businesses, are a priority”, he believes, judging that this commercial extension is not being done “at the right time. Our priority is the city center." An opinion that in no way predicts the decision of the court of appeal, which we will know in a few weeks.
