Death of Kamilya, 7, mowed down in Vallauris: the motorcyclist is not placed in provisional detention, his judicial supervision confirmed

This Wednesday, September 11, the Aix-en-Provence Court of Appeal confirmed the placement under judicial supervision of the 19-year-old motorcyclist, suspected of having fatally hit little Kamilya, 7, on August 29.  

No pretrial detention for the 19-year-old motorcyclist. This is the decision rendered by the Aix-en-Provence Court of Appeal in the case of the death of a 7-year-old girl, knocked down on a pedestrian crossing in Vallauris.

As a reminder, the young man was indicted for “unintentional injuries resulting in total incapacity for work for more than three months through a manifestly deliberate violation of a specific safety or caution obligation by the driver of a motor vehicle”.

His placement under judicial supervision was confirmed this Wednesday, indicates BFMTV. He is required to “report once every two weeks to the Antibes police station" and is prohibited from "entering contact” with Kamilya's family and to leave the Alpes-Maritimes department. 

A "dismayed" family

The tragedy took place on Thursday, August 29, around 7 p.m., as Kamilya and her 11-year-old brother were crossing a pedestrian crossing on a busy departmental road. According to a police source, the motorcyclist was doing a wheelie while going up a line of cars when the accident occurred. Kamilya's family is “dismayed” by the decision not to place the driver in pretrial detention, as their lawyer, Nabil Boudi, told AFP.

Pretrial detention can only be ordered if judicial supervision or the wearing of an electronic bracelet are not sufficient to prevent risks such as the destruction of evidence, pressure on the family or witnesses, or the accused fleeing.
