NFP Promised Repeal: Is Pension Reform Threatened by LFI's Bill ?

While the name of Gabriel Attal's successor is still unknown, the NFP has assured that in the event of access to Matignon, the pension reform would be repealed. One year after its promulgation, is it threatened ?

In the middle of the Olympic Games, the name of the next Prime Minister is not yet known. The left, however, is working to present a candidate so that the NFP, winner of the legislative elections, takes its place in Matignon. The repeal of the pension reform was one of the promises kept during the party campaign which blocked the National Rally.

Act by decree

The pension reform had sparked fierce protests across the country, with numerous demonstrations lasting several weeks. But more than a year after its promulgation, the NFP has not forgotten and still wants it to be repealed and intends to do so if it reaches Matignon. But how ?

Lucie Castets, current candidate for the Union of the Left to succeed Gabriel Attal, wants "to act by decree before submitting a bill in good and due form", indicates BFMTV. And La France Insoumise has already submitted a text. The decrees allow for rapid action but cannot modify the law., especially if there is no absolute majority, underlines constitutionalist Anne-Charlène Bezzina.

Article 40

If the New Popular Front hopes to return to a legal retirement age of 62, it could nevertheless face a problem: opponents of this repeal will certainly not hesitate to invoke Article 40 of the Constitution.

It "is generally used to set aside the provisions of the law concerning financing" and "consists of giving the government and parliamentarians the power to declare inadmissible – that is to say, to prevent any tabling and discussion of amendments or a bill when these or the latter have the consequence of increasing a burden or reducing public resources", explained Anne-Charlène Bezzina.

As a reminder, it was this same article that allowed Yaël Braun-Pivet to end discussions on the bill aimed at repealing the Liot group's pension reform in June last year. "The path therefore seems to me to be still long, even if the bill undoubtedly has a better chance of succeeding than “didn't have that of the Liot group”, concludes the constitutionalist.
