Double news for the industrial tribunal which returned to work on Friday in a room of the Nîmes judicial court. Indeed, if the solemn hearing is an opportunity to take stock of the court specialized in labor law, it made it possible to officially record an official change of president at the head of the council of Prud’men. It is now Jean-Luc Buyck who will chair the board, succeeding Laurence Richard. However, this is not a first for the new president since he has already supervised the jurisdiction as a member of the salaried college. He recalled that the alternation between a president from the employing college then an employee was the rule.

"Advisors are judges in their own right"

Symbolically, Ms. Richard presented her medal to her successor who wore the cord. In this jurisdiction, councilors are elected from lists presented by different employer and employee unions. In his speech, Frédéric Kocher, the deputy public prosecutor of Nîmes, urged the industrial tribunal advisors to practice impartially and with complete independence. « The advisors are judges in their own right, he underlined while indicating that a representative of the Nîmes public prosecutor's office could be present on a case-by-case basis at industrial tribunal hearings, particularly when in certain cases appear to be criminal offenses against labor law, he underlined, referring to « the scourge of moral harassment which has a real social cost. The magistrate asked the advisors to report to the public prosecutor any offenses of which they may become aware, particularly concealed work.

In 2023, 1,054 cases were pending at the industrial tribunal compared to 1,011 in 2022. 858 new cases entered the inventory in 2023 compared to 784 in 2022.
