Violence against minors in foster care: 19 people tried in Châteauroux during an “extraordinary” trial which opens this Monday

The trial of 19 people tried for having taken in minors without authorization, some of whom allegedly suffered physical and psychological violence, humiliation and forced labor, opened Monday morning in Châteauroux.
“We are all happy to be here”, said Mathias, one of the victims, on the steps of the Châteauroux courthouse before the start of the hearing. “For all of us young people, it feels really good, even if we are all a little stressed out. We expect from these five days to be recognized and to be listened to”.
From From 2010 to 2017, dozens of children were entrusted by the Child Welfare Service (ASE) of the North to a reception structure located in Indre, which did not have the necessary approval.
For some of these families, an initial approval had even been withdrawn, following convictions for sexual assaults on minors, as revealed by the investigation unit of Radio France and Mediapart.
In total, dozens of children were allegedly entrusted to the “Childhood and Well-Being” structure, in exchange for compensation amounting to at least 630,000 euros over seven years. They were welcomed by families from Indre, Creuse and Haute-Vienne.
Even more serious, some of these minors say they have been victims of various forms of violence: abuse, drug overdoses, forced labour and regular humiliation.
“These children have been abused, insulted and mistreated, and silence is king”, castigated Me Myriam Guedj Benayoun, one of the victims' lawyers, before the court. “Nobody said anything for seven years”.
For Me Jean Sannier, another lawyer for the civil parties, “we want above all to denounce this murderous time of justice”, seven years “of scarifications in order not to die”.
At least five of the victims are expected to testify during the trial, which is being held before the criminal court until October 18 in Châteauroux.
According to the investigation, the case broke out after one of the children, Mathias, was hospitalized for "a fall from a bicycle" , but he refused, after a week in a coma, to return to his tormentor. A report was then made to the public prosecutor, who revealed repeated acts committed between 2010 and 2017.
“Huge deficiency”
For the civil parties, “we are clearly in an extraordinary trial”, according to Me Sannier. “We have had repeated reports for years to the ASE, the deficiency is immense”, he continues.
Nineteen people are thus called to appear among other things for violence, undeclared work in an organized gang, taking in minors without prior declaration, administering harmful substances or using forged documents.
Among the defendants are two leaders of the association “Childhood and Well-Being”. On the other hand, no ASE official will be tried, which is decried by the civil parties.
“This is the first time that a trial directly points to the ASE”, says Homayra Sellier, president of the Innocence en danger association.
“We would have liked the Child Welfare Service, the DDAS as everyone calls it, to be there to speak out, but it is not there, just as it has not been there since the beginning”, pointed out Me Guedej Benayoun.
The Nord department, which is supposed to issue the necessary approval to families, has refused to “any comment pending the judgment”.”“This is something that is very worrying”, a departmental councilor nevertheless confided to AFP.
In the Nord, cries of alarm have multiplied in recent years, while child welfare is experiencing major difficulties, with ever-increasing numbers of children in need of placement.
The most populated department in France, with large pockets of poverty, the Nord had 22,837 children under protective measures in September, including more than 12,805 placed in foster families or homes.
“I have a lot of hope for this trial”, concludes Ms Sellier. “We have the opportunity to burst a gigantic abscess and offer a second chance to children who have lived through horror.”
