Gard Commercial Court: small businesses are very impacted by liquidations

Jean-Marie Albouy présentera, vendredi, son rapport lors de l’audience solennelle du tribunal de commerce. MIDI LIBRE – EDITH LEFRANC

The solemn hearing for the start of the commercial court will take place this Friday, January 26, in Nîmes.

During the solemn opening of the Gard commercial court, his speech and his very in-depth analysis of the statistics of the past year are always eagerly awaited. Jean-Marie Albouy has been a consular judge at the commercial court for 32 years. This Alesian has presided over the consular jurisdiction for nine years. Jean-Marie Albouy will present his report this Friday, January 26, during the formal hearing of the commercial court. Like every year.

The reference, the year 2019

Certainly, in Gard, in 2023, there was an increase in collective procedures (i.e. 576 judicial liquidations, receiverships, safeguards). "But there is still a slight decrease compared to 2019 (597) which remains our reference (Editor's note: before Covid) or 2017. The cruising speed has not yet been reached but the assignments are not yet reached. rsquo;have not yet fully resumed (Taxes, Urssaf…)", recalls the president of the commercial court. "They should resume from 2024. The funds alerted us that they were going to resume assignments."

The alarm bell for very small businesses

Jean-Marie Albouy is not here to give lessons. "I give figures. I am the guarantor of the judicial institution. I manage a court. I'm just observing. I'm not taking sides, defends the president of the Nîmes commercial court. Certainly, but Jean-Marie Albouy also knows how to “sound the alarm”.

"I warn people. I tell them: be careful"

"91% of collective legal proceedings concern very small businesses (0 to 5 employees). And these companies generate 64 million euros; of liabilities. This concerns more than 300 employees who find themselves out of work. It’s huge! … You should also know that 14% of procedures concern managers who have disappeared." And moving forward: "Why not put in place, for managers, an operating permit’? A business permit… I warn people. I tell them: be careful."
