Une aide-soignante a décidé d'attaquer son employeur, clinique privée de Saint-Herblain en Loire-Atlantique, parce que son contrat n'a pas été reconduit. Elle avait enchaîné 530 CDD.

This healthcare professional has been working in this private clinic in Saint-Herblain, very close to Nantes, for 17 years. Aged 60, this woman decides to sue her employer to the industrial tribunal because her contract has not been renewed. The end of this collaboration comes after she signed 530 fixed-term contracts, reports Ouest France.

"I think I was too expensive"

The sixty-year-old, who always wanted a permanent contract, ultimately settled for the fixed-term contract that was offered to her. If throughout her career she was at 80%, during her last 6-month contract, signed in March 2023, everything had changed. Now, she has a crazy schedule, 48-hour weeks, four nights on call per week".< /p>

Tensions quickly arose with his management. After an incident, she was summoned by the general supervisor, explains Le Parisien. "I'm told that due to a reorganization and an alleged behavioral problem, I won't be called back. And I am even advised not to apply elsewhere", relates the health professional.

According to her, it is a question of remuneration. "I think I was too expensive. I have been a caregiver since 1985. With my seniority, I am paid 200 euros for twelve hours of care. I do ten, I earn 2,000 euros on a fixed-term contract, she says.

"It's a record"

After a simple thank you and this sudden end of collaboration, the caregiver decides to take legal action. "I counted at least 530 fixed-term contracts. This is a record", confides his lawyer, contacted by Ouest France. He explains that he has already dealt with nurses on numerous fixed-term contracts.

"If the fixed-term contract is not exceptional, it is then a permanent contract", he explains. He therefore requests requalification to a permanent contract for his client.
