Un homme a été condamné à 10 mois de prison avec sursis probatoire durant deux ans et des obligations de soins, après l’agression sexuelle d’un enfant de 11 ans.

Last July, a totally drunk man (3.6 g of alcohol in his blood) sexually assaulted an 11-year-old child while the latter was having fun with others young people of his age. He was sentenced to 10 months in prison, suspended for two years. He will also have to seek treatment for his alcoholism. He was registered on the national sex offender file.

He has drunk a lot and caresses her chest

On the evening of the incident, the man approaches a group of teenagers. He drank all day. He approaches an 11-year-old boy, whispers a sentence with sexual connotations to him and caresses his chest. Immediately, the young man gets up and goes to warn the security guard and his brother. The suspect was immediately removed from the Sérignan-plage campsite and when the gendarmes who arrested him, they checked his alcohol level. He has a level of 3.6 g of alcohol in his blood. "I had drunk too much, I don't remember anything. I had an argument with my partner and I drank a lot of beers", he told the court. "I don't even understand what I did. This is the first time I have said such things. I have a big problem with alcohol and I started a course of treatment." Since the events, last July, the defendant is being followed by a psychologist and has not touched a drop of alcohol again. He brought blood tests to court to support his statements. “I miss drinking, yes, I admit it, but what I don't miss are the effects after drinking. After what I did my partner asked me to make a choice. I chose to live well with my partner." We will later learn that from a very young age he tried to treat his alcoholic mother and that when faced with failure he also sank into alcohol.

Aggression is retained, but corruption of a minor is not

The representative of the public prosecutor will ask the court to make a choice. To retain sexual assault and not corruption of minors. Why ? "The aggression is characterized by the fact that he caressed her chest after whispering to her an unambiguous sentence of a sexual nature.  These comments sexualized the gesture on the young person and there was the surprise of the young adolescent that one can imagine." She requested six months of suspended detention, a ban on contact with minors and registration in the national sex offender file.

Me Florence Delfau-Bardy will explain: "This is not a pretty offense. A group of young people are attacked by a very drunk man. He no longer knows what he is doing because he has drunk so much. There is only one act. Just one sentence. No more, no less, but it’s enough. The sexual assault is there, the elements are indisputable. But the expert confirms it, he is not dangerous, does not have pedophile tendencies and his discernment was impaired at the time of the events. We must take all of this into account, his past and his attitude since the events. He chose to take care of himself, to work. That evening, in his state, he committed an act that did not allow him to take care of himself. He attacked a young person. He needs a care order."
