Le prévenu, déféré ce jeudi 4 avril, a rapidement quitté les lieux de l’accident en voyant la police arriver.

The victim, a man in his forties, was bringing his daughter-in-law back to the Purple campus on Tuesday, April 2, when a car hit his motorcycle from behind. Thrown three or four meters, he was slightly injured. Supporting medical certificates, he escaped with an injury to his knees and some bruising. The young woman, 18 years old, with shoulder pain. The two-wheeler is severely damaged at the front.

The alleged perpetrator of these acts, tried in immediate appearance this Thursday, April 4, at the Alès court, is a young man of just twenty years old. Involved in the accident, he is also suspected of a hit-and-run after the impact, in addition to unintentional injuries. Aggravating circumstance, he drives without a license, at excessive speed in a Renault Clio. After going to meet the two bikers on the ground, he suddenly leaves the scene of the accident as a police patrol arrives in their direction.

Two opposing versions

At the stand, the victim evokes an approach "aggressive" on the part of the motorist. "He immediately got out of the car and said to me, You're right! You rocked!". After offering to help the two victims, he allegedly fled while they barely had time to get the motorcycle back together. ;nbsp; He only stayed there for a minute. My wife came to pick us up, he came back to apologize to us as we were leaving. He told us that he was 17 years old, that he already had a record, takes the stand, the victim. "My daughter-in-law is shocked. His dad died in a road accident.

"I was scared, explains the defendant. I didn’ I didn't have the license, it wasn't my car, but that of my partner's grandparents. I borrowed it because I had an appointment at 9 a.m. for work, and I got up at 10 a.m. 40On the spot, I panicked when I saw the police."

He would have subsequently left the car in Rochebelle, before returning to see the injured, who were leaving in a tow truck. "I never said I was 17. I said that I was 20 years old, that I was on probation", he corrects. A suspended sentence which he receives in 2022 for driving without a license, use of drugs and giving a false identity.

The suspended sentence is revoked: prison sentence

For Me Guillaume Garcia, for the defense, the defendant really stopped to see the injured. But for the prosecution, which requires six months in prison with a committal warrant, and a revocation of the suspension of the previous sentence, "stopping must allow to define the responsibilities of all the people involved in the accident. The gentleman seeks to escape his legal responsibilities. The act of repentance does not erase the hit and run".

"Please, with 40 hours in police custody, I’ve learned my lesson. Going to prison at 20 years old is not pretty. Hurting your family is not okay either", adds the defendant, addressing his family present in the room .

The defendant ultimately receives one year in prison, including eight months suspended on probation. Two months of reprieve granted during his previous conviction are revoked. Omar is incarcerated for six months in Villeneuve-lès-Maguelone.
