Lucas Henry, un jeune homme âgé d’une vingtaine d’années est accusé d’avoir violé une personne vulnérable âgée de 83 ans à Alès. Il comparaît devant la cour criminelle départementale du Gard.

It was a patient in the psychiatric unit of the Alès hospital who alerted the staff on October 13, 2022. Placed in psychiatry for a week, Lucas Henry, 23, was in his room, his pants down, lying on Geneviève (name changed), an 83-year-old patient, partially naked and in shock. Geneviève is a mute old lady who has lost all her bearings.

Questioned by a nurse, Lucas Henry defends himself, affirms, a little embarrassed all the same, that he “didn't do anything”. Then adds : “I make love”. And according to the young man, Genevieve was“consenting”. Traces of sperm were found on the bed and on the victim.

The accused claims that the victim was consenting

Accused of raping a person he knew was vulnerable, Lucas Henry, defended by Me Joël Wolfs (from the Tarascon bar) has been appearing since Monday, September 16, before the Gard departmental criminal court. And the young man maintains the improbable version that he had already given to the Alès police. ” This lady was unable to express her wishes, as you can see, insist Dominique Sié, the attorney general, and Christian Pasta, the president of the criminal court. “I swear to you. I asked her what she was doing in my room and if she wanted to have sex with me", the accused claims. Aggressive behavior with other patients

"How come a patient saw you undressing her ?" the attorney general continues. “I helped her undress”, Lucas Henry specifies. At the Alès hospital, Lucas Henry was only supposed to spend a week in psychiatry. He was also known for flirting with other patients, in an aggressive manner, with crude words. “Me, aggressive”? defends himself”the accused. When they say no, I drop the case.”

Lucas Henry, a cannabis smoker, had been placed in a psychiatric ward, at the request of his adoptive mother, who was once again exasperated by his aggressive behavior and violence. The young man who “was losing his cool a bit,” according to his mother had already spent two short periods in a psychiatric ward at Mas Careiron and had been convicted. The psychiatric expert who examined him during his police custody in the context of this case concluded that there was no abolition or alteration of discernment. This is disputed by Me Joël Wolfs, the lawyer of the accused who will plead this Thursday after the requisitions of the attorney general. Verdict this Thursday. Me Magali Fiol represents Geneviève's children, present in the courtroom and civil party in this case.
